The term “eminent domain” can strike fear into the heart of any property owner in Delaware and, indeed, throughout the country. When this process impacts your property, it can become very personal for some people. After all, you put your hard-earned dollars into your real estate purchase – why should another party be able to take it away from you?

It is understandable when emotions run high during the eminent domain process. But, anyone in Delaware who is facing an eminent domain proceeding should know that there are very strict procedures that need to be followed. Your property cannot be taken away from you for nothing or for just any reason – “just compensation” is another term that should be heard on equal footing with “eminent domain.”

So, what is just compensation? Well, it is an amount that is fair and reasonable to compensate a property owner when some or all of that owner’s property is subject to a taking for a public purpose by an appropriate entity. You’ll get offers and copies of appraisals, and oftentimes feel like you need to negotiate a higher amount. In serious disagreements, these cases can proceed to courtroom litigation.
